On top of this, you must report gambling income/loss by "session," whatever the fuck that means, and whatever the fuck sense that makes (none).
Alright, based on this BRILLIANT SYSTEM, let's say the following goes down, and let's say this is the only gambling activity I engage in for 2009/2010:
December 30th, 2009: I play a "session" and win $1,000
December 31st, 2009: I play a "session" and lose $1,000,000
January 1st, 2010: I play a "session" and lose $1,000
January 2nd, 2010: I play a "session" and win $1,000,000
So, what I'm supposed to do on my 2009 tax return is report income of $1,000, and a deduction of $1,000 (since I can only deduct losses up to the amount of my winnings). Correct?
Then, on my 2010 tax return, I report income of $1,000,000, and a deduction of $1,000. Correct?
All told, I am dead $0 on my gambling activity, but I owe the IRS tax on $999,000????

Taxes are usually paid on your earnings. If you were to make or lose the same amount on the stock market, or through a business, you would still have to pay taxes or make deductions in this way.
What is wrong with you?

Holy shit, you're actually trying to justify this?
Lose $1,000 on December 31st: in no way deductible or creditable to the following year's taxes.
Win $1,000 on January 1st: YOU OWE TAX ON THAT, LOL.
And that's just the simplest example.
This shit is just the tip of the iceberg.
Note how the income/deduction thing, and separating by session, rapes you in the maximum possible manner.
Let's say after a series of 100 poker hands you're up $30, and during the course of the next 100 hands you lose $35.
Let's say you play all 200 hands in one "session." So, you are a $5 loser overall, and that $5 loss for the session would be recorded as a deduction (but only, that is, if you have at least $5 in winnings at some point to offset it!!!!).
But let's say you played the first 100 hands, ended your "session," then came back and played the next 100 hands the next day. Now you'd have two "sessions" - one recorded as an income of $30, and the second recorded as a deduction of $35.
For tax purposes, "deduction of $x" is very, very different than "income of $y minus a deduction of $z, resulting in a difference of $x".
There is absolutely nothing meaningful about the difference between one "session" and the next, in terms of what you are doing. Every hand is an independent event.
And, if you played no more poker for the remainder of the year than those 200 hands, you couldn't even deduct all $35. You could only deduct $30, since, again, you can only deduct losses up to the amount of your winnings!
Do you not see how this is absolutely and totally fucking CARTOONISHLY absurd and rapingly unfair?
As the dollar amounts rise, and income tiers and deductions and shit start entering into it, the FUCKING BULLSHIT only magnifies.
Let's say you play poker once in January and win $1,000. Then you play again in July and lose $1,500. Again, the win counts as part of your gross income. It goes on the first page of your 1040, or “above the line”. If you want to itemize your deductions, you can claim $1,000 (NOT $1,500, LOL) on Schedule A. Then that flows onto the second page of your 1040, “below the line”.
If you weren't already itemizing deductions, by itemizing now you lose the standard deduction that you had before. In 2003 the standard deduction was $4,750 for single filers. If you have $5,000 in winning sessions and $5,000 in losing sessions, you will add $5,000 to your gross income, lose your standard deduction of $4,750 and add a new itemized deduction of $5,000. Although you broke even for the year, your income has increased by $5,000 and your deduction has increased by only $250. I am not making this shit up!
How about this little trick?
IRS docs say that: You must report the full amount of your gambling winnings for the year on Form 1040, line 21. You deduct your gambling losses for the year on Schedule A (Form 1040), line 28. You cannot deduct gambling losses that are more than your winnings. Nonresident aliens cannot deduct gambling losses on Schedule A.
So nonresident aliens must report their gross winnings, and can't even deduct their losses!! A nonresident-alien could conceivably, if broken down by session, have $100,000 in wins, $120,000 in losses (so be a $20,000 loser for the year), and owe the IRS another $35,000 or so because he wasn't allowed to deduct his losses!
THIS IS UNMITIGATED, MOTHERFUCKING MADNESS. THIS IS STRAIGHT UP, BROAD DAYLIGHT *PLUNDERING* OF PEOPLE'S MONEY.
Gambling simply does not work the way the legislation deals with it. Bets go out, bets come back. It's a flow of money, like a tide going in and out. It isn't fucking income/deduction/income/deduction. You just can't separate it that way, especially when all the other horseshit about tax brackets and what not enters into it.
I love it when people are so conditioned to me trolling or whatever that they just automatically disagree with whatever position I take on whatever it is I get riled up about, even when it's something absurd that I have a perfect right to be livid over, especially something like this that touches close to home. Like I'm categorically an idiot just because I'm an idiot about some things, sometimes! |

Winnings are taxed in full because the government wants your money.
Losses are not deducted in full because generally you losing at gambling does not positively impact society in the way that, say, you running a business or you buying a house might.
I mean, what, if you are just a compulsive gambler and lose all your money, you should be EXEMPT from income tax because you get to deduct your gambling losses? |
