Harvey is dead. Batman survived because he's fucking Batman. They showed him get up. Dent's head was tilted and his picture was shown to a crowd. If you understood film, you'd know those are clear signs of confirmed deaths.

But since this movie censors itself so often it's a little confusing. They could have shown Harbey's dead, open eyes glazing over, but instead chose to shadow them out.

It's funny how imperfect Fist of Legend actually is, but no critic worth a copper will dare give it a negative review.

I think the best way to re-use Joker, Two-Face (or both) for a third movie would be to have them remain in Arkham the entire time, a la Hannibal Lecter (and concentrate the film on another villain/threat). It would be most dramatic that way, I think, since they're such psychologically-driven characters anyway. Plus I don't think it's possible (or wise) to try and top their antics in The Dark Knight. Unfortunately, it might actually seem too much like Silence of the Lambs if not done vary carfully.

I think Two-Face is alive, just hidden away in Arkham from public knowledge. Batman survived the fall, and Harvey is just as awesome, so therefore, so did he. Batman was pretty adamant about preserving his dignity and reputation, hence the probable cover-up.

It's funny how 8 bit cites the memorial as hard evidence of Dent's death when in that same movie they do the exact same thing for Gordon (and even go so far as telling his wife and family he is dead).
